Working Time Directive

 

Pyxis Clock:In helps employers meet their committments under the EU Working Time Directive

 

The EU’s Working Time Directive (2003/88/EC) requires EU countries to guarantee the following rights for all workers

 

  • a limit to weekly working hours, which must not exceed 48 hours on average, including any overtime
  • a minimum daily rest period of 11 consecutive hours in every 24
  • a rest break during working hours if the worker is on duty for longer than 6 hours
  • a minimum weekly rest period of 24 uninterrupted hours for each 7-day period, in addition to the 11 hours' daily rest
  • paid annual leave of at least 4 weeks per year
  • extra protection for night work, e.g.
  • average working hours must not exceed 8 hours per 24-hour period,
  • night workers must not perform heavy or dangerous work for longer than 8 hours in any 24-hour period,
  • night workers have the right to free health assessments and, under certain circumstances, to transfer to day work.

 

 

Working Time Records

 

The Working Time Directive ensures that  workers do not have to work excessive hours or excessively at night and are entitled to adequate rest and holidays. These principles apply to all workers and require employers to keep records to show that the provisions of the Directive are being complied with. As the Directive applies to all ‘workers’, this covers everyone except for those who are genuinely self-employed.

 

The most important exception applies to workers on ‘unmeasured time’, such as those in management positions, which allows them to determine what hours they work and when. However, these workers are also subject to the 48-hour working week limit but only in respect of time that they are contractually required to work. Any additional hours they may choose to work remain unmeasured time and are not covered by the regulations.

 

United Kingdom

There is a requirement for employers to keep records that show that they are complying with the weekly working time limit. It is for the employer to determine what records need to be kept for this purpose. More information is available here.

 

IRELAND

Organisation of Working Time (Records) (Prescribed Form and Exemptions) Regulations 2001 requires all employers to keep detailed records of start and finishing times, hours worked each day / week and annual leave. This legislation is part of the Organisation of Working Time Act 1997. The employer must keep all working time records for a minimum of three years.

 

The legislation requires employers who do not have a way of recording employee working hours electronically (that is, using a clock-in system) to complete a special form called the OWT1.
